Terms and Conditions

 

 

     Article 1 : Scope

 

     These general conditions of sale are concluded between :

     - Firstly, ChatMage, whose registered office is situated in Midi-Pyrenees;nées,

     - And secondly, any natural person or no, no trader, wishing to order on the online store ChatMage (www.chatmage.com).

     No special conditions may prevail over these terms and conditions unless otherwise stated and written by ChatMage. If a condition is missing, then apply the distance selling rules of the place where the head office of ChatMage is.

     ChatMage reserves the right at any time to modify these terms and conditions of sale.

    

     Article 2 : Buyer's Acceptance

    

     When the buyer confirms the order, he claims to have prior knowledge of these terms and conditions, understand them and accept all terms irrevocably.

  

     Article 3 : Users 

    

     The online store ChatMage is reserved to private individuals wishing to purchase one or more items for their personal use. Commercial use within a professional activity or not, of products ordered is prohibited.

 

     The buyer declares to be major.

 

     Article  4 : Purpose

    

     These terms and conditions are available on the www.chatmage.comsite .

     They are intended to define the rights, duties and obligations of both parties, that is to say ChatMage and client through a command on the online store ChatMage and during the various stages of this order (order confirmation, payment, delivery and any other service offered).

 

     Article 5 : Product

 

     The items for sale are available on the www.chatmage.com site and are offered within the limits of available stocks. ChatMage reserves the right to add or remove items at any time. In case of unavailability of an item after confirmation of the order, we will notify the customer as soon as possible and ChatMage will propose, at the customer’s choice, the option to choose another item or cancel the order.

 

     The articles are accompanied by a description of their characteristics as well as one or more visual (images). We take great care to make the most accurate data as possible. However, ChatMage can not be held responsible for a slight difference (as to colors, for example). It should also be noted that the visuals available on the site contain a watermark which is obviously not present on the documents for sale.

 

     Article 6 : Order

 

     Orders must be made solely on the online store ChatMage : www.chatmage.com. The full payment (including the item price and shipping cost) is carried out only once.

 

     ChatMage reserves the right to refuse any order not complying with these terms and conditions or in the event of default of payment of the aforesaid order or if there is a dispute between the client and ChatMage about a previous order. Indeed, a refusal to sell may be opposed to the client if it has not fulfilled its obligations, that is to say if there is a default in payment of all or part of the previous order.

 

     ChatMage can not be held responsible in the event of fraud or other wrongdoing by the client or the user.

 

     ChatMage is not responsible for any data entry errors when ordering or creating the account. It is the customer to verify the information provided (such as address, for example, so that ChatMage have your complete and correct address).

 

     Orders can be tracked in "My Account" available on the website of ChatMage :  www.chatmage.com

 

     In order to respect the environment, ChatMage does not send paper invoices with order. An invoice will be mailed upon confirmation of your order at the store. You also have the option to consult your user account in your order history.

 

     If you want a paper invoice is sent with your items, thank you specify when ordering so that it can be included with your package.

 

     Article 7 : Rates

 

     The prices of the items listed in euros (and must be paid in euros). Prices are excluding of taxes due to the "VAT not applicable, Art. 293 B of the CGI."

     ChatMage reserves the right to change prices at any time but items prices will be consistent with the rates in effect at the time of confirmation of the order, subject to availability.

 

     Shipping costs are the customer’s responsibility and payable in euros as well. They are not included in the price of items. They are charged in addition.

 

     Any customs duties or local taxes depending on the country of destination are payable by the customer.

 

     Article 8 : Terms of payment

 

     Payment can be made :

 

  • by credit card via paypal secure service,

  • by bank transfer,  

  • or by check in euros, sent to a maximum of 3 days after confirming the order, and payable at a bank domiciled in France.

       Order numbers must be attached to checks.

       The cashing of the check is made upon receipt. 

     The buyer declares having the required permission to the payment method he chose. 

     In the case of payment by credit card or bank transfer, the command's preparation time (maximum 7 days) will begin upon receipt of the payment. In the case of payment by check, the order preparation time (maximum 7 days) will begin upon receipt of the check. In the case of a bank transfer, the order processing will be made upon registration of transfer. 

     ChatMage retains full ownership of the items sold until payment of the entire order, that is to say, the full payment of the articles, shipping costs and other mandatory fees.   

     Article 9 : Unavailability articles 

     The articles in the online shop www.chatmage.com are proposed subject to availability. In case of unavailability of an item once the order recorded, we will notify the customer as soon as possible. The customer then has the option to either cancel the order or to modify it by mail by writing to the following email address  : contact@chatmage.com or by writing to us through the form « Contact ». 

     Article 10 : Delivery 

     The order is delivered to the address provided by the customer. If the customer wants the order to be delivered to a different address than the billing address, he must mention the delivery address when ordering.

    

     As stated in the article on orders of these terms of sale, the customer agrees to provide at the time of order valid information and right. If the order could not be delivered because of wrong information from the delivery address (error or incomplete address) ChatMage would not be responsible for non receipt of the items and return shipping charges are payable by the customer. 

     It is the responsibility of the customer to check the state of their package and it is his responsibility to make reservations with the postal services if they observe damage to the packaging.

 

     If items damaged in transit, the customer is requested to contact ChatMage within two days either the contact form of the online shop (www.chatmage.com) which is available in the "Information" section by clicking on « Contact » or by sending an email to the following email address:   contact@chatmage.com . If this is not the case, the order is considered accepted by the customer and any other complaint related to delivery will not be accepted and considered.

     Article 11 : Delivery time 

     The order will be processed once payment received (validated by paypal or once the payment is register in the case of a transfer, when received in the case of payment by check) and will be shipped within a maximum period of 7 working days . The times indicated in the confirmation of the order are subject to change when paying by bank transfer or check.

     Orders are sent by post to the address that the client specified when ordering.

    

     The delivery times indicate when ordering are provided for information only and without warranty. ChatMage is not responsible for any damage or possible delays extended by the Post Office. A delay in delivery where ChatMage would no responsibility does not allow the customer to cancel the sale or to refuse items to claim payment of damages, or benefit from any reduction as the order is delivered within 30 working days.

 

      You can choose the shipping method when ordering for all items (except for mugs). You can opt for a shipment with or without tracking number. All items (except for mugs) can be sent to the "letter" price (followed or not). Only mugs are, of course, be sent in packages. If your order includes mugs and other items (such as stationery, for example), your entire order will be sent in package.

     Sending green letter and international priority mail does not provide a tracking number or be refunded in case of loss or damage of the package.

     If an order has not been delivered after the deadline in the time of receipt of payment, order preparation and delivery, the customer can contact the Post Office and ChatMage. In case of loss of the package and once the investigation of the Post Office conducted and the package said actually lost (for shipments Colissimo or letter followed) ChatMage propose to the customer returning the order subject to availability or else the repayment thereof by check, transfer or credit note. 

 

   

     All refunds will be made to the customer who placed the order and sent in the case of a refund by postal check to the billing address for the order.

 

 

     Article 12 : Shipping costs 

     Shipping costs may vary depending on the weight of your order and the country of delivery. 

     Shipping costs are offered from 60 euros to buy, whatever your country of residence. However, customs duties and any taxes due to the importation of products in your country are your responsibility.

     Article 13 : Right of withdrawal and return 

     According to the law, the customer has a fourteen-day withdrawal period from the date of receipt of the order.

    

     If the customer wishes to exercise this right, he must inform ChatMage in fourteen days after receipt of the items either by the contact form on the webshop (www.chatmage.com)  available by clicking on  « Contact » at the top of the site or by clicking on « Contact Us » in the "Information" section at the bottom of the page, or by sending an email to the following email address  :  contact@chatmage.com . The customer must return the items at the latest, within fourteen days after the communication to ChatMage of his decision to exercise his right of withdrawal.

    

     Return costs (including transport packaging and postage and possibly, depending on the country, customs fees and local taxes) are chargeable to the client.

     It is up to the customer return the items without having deteriorated or damaged and in original packaging. Similarly, the customer must ensure that the returned items arrive in perfect condition. It is the customer's responsibility to ensure that the items are properly protected during transport to prevent their deterioration. If they arrive damaged or soiled in ChatMage (by the client or during transport), no refund will be made and they will be returned to the customer at his expense.

     It is advisable to send the items by registered mail in order to prevent the loss or non-delivery. ChatMage can not be held responsible for non-receipt of the returned items.

     Following the return of the items, ChatMage reimburse the customer with the same means of payment used by the client to pay the order. Reimbursement will be made within fourteen days as of actual receipt of effective returned by the customer (provided that they are not damaged). ChatMage refund the amount of the order (including the item price and shipping costs but not the cost of return, which are the customer’s responsibility). For the amount of reimbursed expenses of delivery, ChatMage will reimburse standard shipping costs even if the client had chosen express delivery method.

     If we made a mistake in sending one or more items, we will pay at the customer the cost of return and we will offer him either send at our expense, the item ordered, or a refund of item . All refunds will be made to the customer who placed the order and sent in the case of a refund by postal check to the billing address given by the user for the order. 

 

     Article 14 : Responsibility 

     The items sold on the online shop ChatMage respect the French legislation and French standards. ChatMage can not be held responsible in case of non compliance with the legislation in force in the country where the items are sent. 

     ChatMage can not be held liable for any damages whatsoever due to the purchase of products or resulting from improper use. 

     ChatMage can not be held responsible for problems of any kind, arising from the use of a computing device and the internet network to connect to ChatMage web site, place an order or contact ChatMage. 

     Article 15 : Force majeure 

     In case of force majeure or unforeseeable events such as those described by French law, these general conditions of sale may be suspended, which would, in fact, the suspension of the obligations of both parties - the client and ChatMage - resulting of these terms and conditions of sale. 

     Article 16 : Confidentiality 

     In accordance with the law « informatique et libertés » of 6 January 1978 amended in 2004, you have a right to access and rectify information concerning you, that you can exercise by writing to contact@chatmage.com . The information requested is your name, first name, your address, your e-mail. It is also asked to create a password.

     ChatMage commits not to transmit to third parties personal data transmitted during the opening of the account, the order or when registering to the newsletter.  This information is collected in order to process the order and are required to make delivery.

     The online store ChatMage has been declared to the CNIL. 

     Article 17 : Intellectual Property 

     All the elements, whatever they are and whatever their nature, listed on the site, the online shop ChatMage -  such as text, photographs, visual, logo, for example, but this list is not exhaustive - are the exclusive property of ChatMage. It is therefore prohibited to reproduce and / or reuse. 

     Article 18 : Applicable Law 

     This contract is written in French.

     These general conditions of sale and purchase transactions are governed by French law.

     Any dispute, which no amicable settlement could not be found, will be treated by the jurisdiction of the courts of the headquarters of ChatMage.
